General Business Conditions

This English translation of the GBC is provided solely for the convenience
of our customers and is not binding. The German full version is the sole
authoritative version in case of any conflict.

1. General
We sell solely with the following general business conditions if not otherwise
agreed in writing. The buyer is entitled to sell the products also via his
own webpage. Selling by means of third party platforms (e.g. eBay, Amazon) is not allowed. Orders are to be put in writing.

2. Trademarks
All trademarks, service marks and trade names of Speedminton®. You may not use, copy, reproduce, republish, upload, post, transmit, distribute, or modify Speedminton® trademarks in any way, including in advertising or publicity pertaining to distribution of materials on the Site, without Speedminton®'s prior written consent.
The use of Speedminton® trademarks on any other website or network computer environment, for example the storage or reproduction of (a part of) the Site in any external internet site or the creation of links, hypertext, links or deep links between the Site and any other internet site, is prohibited without the express written consent of Speedminton®.

3. Offers and Prices
All offers by Speedminton GmbH are subject to changes and errors, all rights are
reserved. Our prices are to be understood EXW Sachsen, Germany and are mentioned in
EURO. Minimum order value is Euro 250,-- per order for orders from EU countries. For non-EU countries the min. order value is EURO 500.
For orders below these values Speedminton GmbH charge a 25-EURO-handling fee.

4. Acknowledgement of Order
An order becomes binding with the written acknowledgement of order or when
the goods are delivered. The buyer is obliged to review the AO and to inform
Speedminton GmbH about errors, otherwise the order is binding.

5. Time of Delivery
The delivery time begins on the date of the written acknowledgement of order
But not before all items are specified.

6. Delivery and Transfer of Risks and Hazards
In general the delivery condition is EXW Hilmersdorf. Transports are carried out
at the risk and expense of the buyer. Risks and hazards are transferred to
the buyer when the merchandize leaves the Speedminton warehouse. Transport expenses are itemised in the invoice.

7. Notification of Defects, Warranty
The buyer is obliged to examine the merchandise immediately after receipt,
Obvious defects must be notified in writing within 10 days, hidden defects
Immediately after detection. In case of failure warranty is excluded. Only postage
paid claims are accepted and handled. In case of justified claims warranty applies within 6 months from the date of delivery, either by replacing the defective merchandise or by crediting the equivalent value. Only postage paid returns are handled. Time-worn products and self-caused defects are not accepted as warranty.

8. Return of Merchandise
The return of sold products is generally excluded unless permitted in writing prior to returning the merchandise in exceptional cases. The return of special price or discontinued products is not permitted.

9. Terms of Payment
The international terms of payment are agreed upon individually. In case of default of payment within the stipulated time period default interest of at least 4% above the German Federal Central Bank base rate is due and payable.

10. Retention of Proprietary Rights
The product remains in the possession of Speedminton GmbH until all existing
Claims are settled.

11. Data protection
The buyer is instructed in accordance with §28 I of the German data protection law, that we safe its complete address, all information necessary for the billing and business in machine readable form. The data are not transmitted to third parties without specific approval of the buyer.

12. Arbitration
Any dispute which may occur out of or in relation to any of the provisions of the GBC shall be governed and construed according to German Law and submitted to the exclusive jurisdiction of the Courts of Berlin, Germany.
